1. General Provisions

1.1. This User Agreement  governs the relationship between THE THINKSTERS  and an individual undergoing an online assessment via the Signal / The Thinksters Signal service.

1.2. This Agreement shall be governed by the laws of the Russian Federation.

1.3. Use of the Service, including the commencement of the interview process, constitutes full and unconditional acceptance of the terms of this Agreement.

1.4. If the User does not agree with the terms of this Agreement, they must cease using the Service.

2. Subject of the Agreement

2.1. The Operator provides the User with the opportunity to undergo an online assessment of their professional profile based on:

• video and/or audio responses,
• text responses,
• automated data analysis,
• generation of an analytical report and recommendations.

2.2. The assessment results are for informational and advisory purposes only.

2.3. The Operator does not guarantee:

• receipt of a job offer,
• invitation to an interview,
• employment,
• interest from specific employers.

3. User Participation Conditions

3.1. The User confirms that they:

• provide accurate information,
• answer questions independently,
• follow the instructions displayed within the Service interface.

3.2. The User is prohibited from:

• using prompts, AI tools, third-party services, or assistance from other individuals when preparing responses;
• misrepresenting their experience;
• attempting to manipulate the assessment system.

3.3. The Operator reserves the right to:

• invalidate assessment results,
• refuse to share data with employers,
• block access to the Service
  in case of violation of the Agreement terms.

4. Personal Data and Processing

4.1. The User consents to the processing of the following personal data:

• full name and contact details (phone number, email);
• CV/resume;
• video and audio recordings of responses;
• transcripts of responses;
• analytical assessment results;
• any other data provided by the User.

4.2. Purposes of data processing:

• assessment of competencies;
• generation of analytical reports;
• sharing data with potential employers (subject to meeting threshold criteria);
• improvement of the Service.

4.3. Data processing is carried out using:

• automated algorithms,
• AI models,
• third-party technical services.

4.4. The User agrees to the cross-border transfer of personal data in cases where the Operator uses foreign data storage and processing services.

4.5. The retention period of personal data is determined by the Operator and may last until:

• the User withdraws consent, or
• the purposes of processing are achieved.

5. Data Sharing with Employers

5.1. The User’s data is shared with third parties (employers) only if the assessment results meet established criteria.

5.2. Shared data may include:

• User profile,
• assessment results,
• contact information.

5.3. The Operator is not responsible for:

• actions of employers,
• hiring decisions,
• further processing of data by employers.

6. Automated Decision-Making

6.1. The User is informed and agrees that:

• the assessment is conducted in an automated manner;
• algorithms and AI models are used;
• the final recommendation is not a definitive hiring decision.

6.2. The User has the right to request a general explanation of the results without disclosure of methodologies or algorithms.

7. Limitation of Liability

7.1. The Operator shall not be liable for:

• the User’s career decisions;
• rejection by employers;
• mismatch between User expectations and assessment results.

7.2. The Service is provided on an “as is” basis.

8. Intellectual Property

8.1. All Service materials, including:

• methodologies,
• algorithms,
• signals,
• reports,
• interface solutions

are the intellectual property of the Operator.

8.2. The User is not entitled to:

• copy,
• distribute,
• use assessment results for commercial purposes
  without the Operator’s prior written consent.

9. Withdrawal of Consent and Data Deletion

9.1. The User has the right to:

• withdraw consent for data processing;
• request deletion of personal data.

9.2. Requests must be sent to the email specified in Section 12.

9.3. Data deletion is possible except where otherwise required by applicable law.

10. Amendments to the Agreement

10.1. The Operator reserves the right to amend this Agreement unilaterally.

10.2. The current version of the Agreement is published within the Service.

10.3. Continued use of the Service constitutes acceptance of the updated version.

11. Dispute Resolution

11.1. All disputes shall be resolved through pre-trial (out-of-court) procedures.

11.2. If a dispute cannot be resolved amicably, it shall be submitted to the court at the location of the Operator in accordance with the laws of the Russian Federation.
